BidsWorks may obtain or process tender information from public procurement sources, contracting authorities, third-party platforms and other sources.

We make reasonable efforts to provide useful and relevant information.

However, we do not guarantee that tender information is:

  • complete;
  • accurate;
  • current;
  • available;
  • correctly interpreted;
  • suitable for your business; or
  • still open for applications.

The official contracting authority and official procurement documentation should always be treated as the authoritative source.

You are responsible for checking:

  • matches;
  • scores;
  • rankings;
  • classifications;
  • suitability assessments; or
  • other indicators of potential relevance.

These are estimates and automated assessments intended to assist you.

A tender match does not mean that:

  • you are eligible;
  • you satisfy all requirements;
  • you are likely to win;
  • you will be shortlisted;
  • the contracting authority has approved your business; or
  • BidsWorks guarantees a successful outcome.

You remain responsible for determining whether a tender is appropriate for your business.

8. Artificial intelligence

BidsWorks uses artificial intelligence, including technology provided by Anthropic, to power certain features.

AI may be used to process:

  • business information;
  • tender information;
  • procurement requirements;

  • document analysis;
  • tender preparation;
  • tender completion; and
  • procurement research.

9. AI output

AI-generated output is provided for assistance and information purposes.

AI systems can produce errors, inaccuracies, omissions or inappropriate recommendations.

You must independently review AI-generated information before relying on it.

In particular, you should verify:

  • tender deadlines;
  • eligibility;
  • legal requirements;
  • procurement requirements;
  • contract values;
  • technical specifications;
  • qualifications;
  • certifications;
  • business experience;
  • pricing;
  • references; and
  • any claims about your business.

You remain responsible for the final content of any tender, proposal, application or submission.

BidsWorks does not guarantee that AI-generated information will be accurate, complete, current or suitable for your circumstances.

10. No guarantee of tender success

BidsWorks does not guarantee that using the Services will result in:

  • finding a suitable tender;
  • being eligible for a tender;
  • being shortlisted;
  • winning a tender;
  • receiving a contract;
  • generating revenue;
  • improving your bid score; or
  • achieving any particular commercial outcome.

Any statements about potential opportunities, suitability or likelihood of success are informational and should not be interpreted as guarantees.

11. Customer Content

You retain ownership of Content that you upload to BidsWorks.

You grant BidsWorks a non-exclusive, worldwide licence to host, store, reproduce, process, analyse and otherwise use your Customer Content to the extent reasonably necessary to:

  • maintain and secure the platform;
  • troubleshoot technical problems; and

This licence continues for as long as necessary to provide the Services and comply with our legal obligations.

We do not acquire ownership of your Customer Content merely because you upload it to BidsWorks.

12. Uploaded documents

You may upload documents to your BidsWorks customer profile.

Uploaded documents may be stored within your Account and used to provide functionality including:

  • finding tenders;
  • matching tenders;
  • analysing your capabilities;

You are responsible for ensuring that you have all necessary rights and permissions to upload and process those documents.

13. Responsibility for Customer Content

You are solely responsible for your Customer Content.

You represent and warrant that:

  • you own the Content or have the necessary rights to use it;
  • you are authorised to provide it to BidsWorks;
  • its use by BidsWorks will not breach applicable law;
  • it does not knowingly contain fraudulent information;
  • it does not infringe third-party intellectual property rights; and
  • you have any necessary lawful basis to provide personal data contained within it.

You must not upload information that you are prohibited from sharing.

14. Personal data

Where Customer Content contains personal data belonging to other individuals, you are responsible for ensuring that you have an appropriate legal basis for providing that information to BidsWorks.

You should avoid uploading unnecessary personal information.

Our processing of personal data is described in our Privacy Policy.

15. Third-party AI services

BidsWorks uses third-party AI technology, including Anthropic, to provide certain functionality.

Where necessary to provide an AI-powered feature, relevant information from your Account or uploaded documents may be processed by the applicable AI provider.

BidsWorks will use appropriate contractual and security arrangements for such processing.

You acknowledge that the use of AI-powered features may involve processing by third-party technology providers.

  • source code;
  • systems;

You retain ownership of any underlying intellectual property that you independently own.

The applicable renewal price will be communicated to you in accordance with applicable law.

You can cancel your Subscription in accordance with the cancellation procedure provided by BidsWorks.

23. Cancellation

You may cancel your Subscription using the cancellation functionality provided by BidsWorks or by contacting us where applicable.

Unless otherwise stated:

  • cancellation prevents future renewal;

Nothing in these Terms excludes or limits any statutory cancellation or refund rights that apply to you.

Refunds will be handled in accordance with the applicable Subscription terms and applicable law.

Where you are legally entitled to a refund, we will provide it in accordance with those legal requirements.

We may offer discretionary refunds or credits in particular circumstances at our discretion.

  • AI providers;
  • payment providers;
